Terms of use and privacy (English)

What this is
Fabelfeuer is a roleplay service that a few friends built for fun and that is now open to everyone. It is free of charge and non-commercial. Voluntary donations help with the server costs but buy nothing: a donation brings no service and no preference in return. It is run by a group of people, not a company (the "operators"). The controller under the GDPR is David Kaufman, reachable at hello@fabelfeuer.com.
The operators can suspend or end access at any time, and the service can go down or change at any time. There is no promise of availability.
Who may take part
- Fabelfeuer is open to everyone. If you are under 18, you may use it only with the agreement of a parent or guardian. That person sets up the account for you or agrees to it, accepts these terms and the privacy notice on your behalf, and is responsible for your use.
- Adult content is only for people aged 18 or older, and only if they switch it on themselves in the settings.
- You use only your own account and do not share it.
- There are daily limits (replies, images, videos, voice), meant to be the same for everyone so that everybody gets a turn.
- Without an invitation you can try fabelfeuer once, as a trial: after signing in with Google or Discord you get a small number of coins, one time, for a few turns of a starter story. There is one trial per person. A trial account that has not been used for 30 days (the number may change; the app tells you) is deleted.
What is forbidden
- Sexual content involving minors, or characters written or depicted as minors. Excuses like "she is actually 500 years old" do not count.
- Real, identifiable people in sexual or degrading content, in text or in images.
- Uploading or recreating real people's pictures or faces.
- Anything illegal in Germany, such as incitement to violence or glorifying real violence.
- Harassment: using the service to harass or threaten someone.
For a breach the operators can suspend or delete your account, without warning for serious breaches.
What happens to your data
In short
- Your scenes are private. The operators read them only when something is broken or someone reports a breach.
- There is no advertising, no tracking, and nothing is sold.
- So that replies, pictures and voices can be made, the parts needed go to other companies (see the table).
- You can export your data and delete your account at any time.
What is stored: your login (name, email, passkey via Pocket ID, the login service the operators run themselves on their own server; if you sign in with Google or Discord instead, the name, the email address and whether that provider has verified the address), your scenes, characters and settings, the generated images and audio, and your usage counters for the daily limits. Without the login data you cannot use fabelfeuer. The operators' server logs also hold technical details of every request, such as your IP address.
On what basis (GDPR):
- Account, scenes, replies, pictures and voice: the usage relationship with you (Art. 6(1)(b)).
- Security, fault-finding, monitoring, server logs, the automatic check for forbidden content, and the bot check and the limit per network when a trial is started: the operators' legitimate interest in a secure, working service (Art. 6(1)(f)).
- Microphone and adult content: your consent (Art. 6(1)(a)). Because adult content can touch on details of a person's sex life, that is explicit consent under Art. 9(2)(a). You can withdraw it at any time: stop using the microphone, switch the adult option off in the settings. What happened until then stays lawful.
Who can see it:
- Your scenes are private. Other players cannot see them.
- The operators can technically read them, because they sit in the operators' database. They do so only to fix a fault or to follow up a report of a breach, never out of curiosity.

Pictures and videos are made on the operators' computer or on rented graphics cards, voices at Fish Audio. There is no advertising, no usage analytics or tracking, and no sale of data. Error and performance data go to Sentry (see the table).
USA: Some recipients are in the USA or belong to US companies (Cloudflare, Google, Discord, Featherless, Fish Audio, the providers of rented graphics cards, Sentry). The transfer rests on the EU-US Data Privacy Framework or on standard contractual clauses, whichever the provider offers.
Automatic checks: Checks for forbidden content run automatically and can refuse a request or hide a picture. No account is blocked or deleted automatically; the operators decide that.
Cookies and browser storage: Fabelfeuer sets only strictly necessary cookies (for the login) and remembers a few settings in your browser (the last studio used, the collapsed side bar, the note about voice input). This serves operation, not advertising or analytics.
How long: until you delete your account. Under Account you can export your data and delete your account at any time. A trial account that has not been used for 30 days is deleted by itself, with its scenes, so export what you want to keep. So that a trial is not given twice, a salted hash of the email address (a scrambled value, not the address) and the date of the trial are kept after the account is gone; they hold no scenes and no name. IP addresses are kept for the limit per network only as such a salted hash, for 7 days. Encrypted backups are kept for 60 days and then expire; a deleted account can therefore remain in a backup for up to 60 days, but it is not restored. Server logs and error reports (Sentry) are kept for up to 90 days and then deleted.
Your rights under the GDPR (access, rectification, erasure, restriction, objection, portability, withdrawing a consent) you can mostly exercise yourself under Account, otherwise by email to the operators. You may also complain to a data protection authority.
Who owns what you write
You. You keep the rights to what you write and generate. You allow the operators only to store and process it so the service works. If a shared library ever exists, the operators will ask you separately.
Liability
The service is provided as it is. The operators are not liable for outages or lost scenes; that is why there is an export. What the language model writes is invented fiction, not a statement by the operators.
Changes
If the operators change these rules, the text gets a new version number and you have to accept again before you continue. If you do not accept you cannot use the service, but you can always export and delete your account.
